Stuardly Terms and Conditions
1. Acceptance of Terms:
IF FOR ANY REASON YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT AND ACCEPT ITS TERMS, YOU MAY NOT USE OR ACCESS THE STUARDLY PLATFORM IN ITS ENTIRETY.
- STUARDLY HAS THE ABILITY TO CHANGE OR UPDATE THESE TERMS AT ANY TIME. IF YOU DO NOT AGREE TO ANY POINTS OF THE UPDATED TERMS AND CONDITIONS, YOU ARE RESPONSIBLE FOR THE DEACTIVATION OF YOUR ACCOUNT.
- By creating a profile on Stuardly, both Owners and Pros agree to abide by these terms and conditions, and the Community Pledge as it states;
- The Community Pledge:
- I agree to be part of the Stuardly Community whos values of Honesty, Respect, Communication, Truth and Humility. These values govern how I speak to others whether it be through the Stuardly Platform, or on the job location. I understand that issues and disputes may arise that will need to be discussed. I will be humble and truthful when I have made a mistake, I will forgive and have grace for others I am working for, or who are working for me. I agree to communicate well and quickly when a dispute arises, and work to its mutual completion for the best of the other parter and myself. I agree to bring the most value I possibly can to my community to ensure the benefits of others on the Stuardly Platform, and will in no way intentionally harm other users, or the platform.
2. User Profiles:
- Owners and Pros are required to create profiles with accurate and up-to-date information. Information collected on your profile is protected by our Privacy Policy.
- Users profiles may be deactivated at any time and for any reason deemed neccesary by Stuardly. Reasons can include but are not limited to; Fake/false information, multiple profiles created, abuse of the system, innapropriate images or text of a sexual or grotesque manner, foul or abusive language in chats, inactivity on the platform, creating false or misleading job postings, complaints recieved or reports of complaints where we deem neccesary to remove your account.
3. Quote and Payment:
- Pros can provide quotes for services, and Owners are responsible for accepting quotes and making payments.
- Payments will be held in trust until the completion of the job.
4. Ratings and Reviews:
- Both Owners and Pros have the ability to rate and review each other based on their experience.
5. Data Privacy:
- Stuardly will not sell or distribute the personal information of Owners or Pros.
- User data will be used to enhance the platform and improve the user experience.
6. Refunds:
- Refunds are available if the Owner cancels a job with more than 24 hours until the scheduled start time.
- If a Pro cancels a job, funds will be automatically deposited back into the Owner's account.
7. LIABILITY:
- Owners and Pros must sign a release agreement, agreeing not to sue each other for damages related to services rendered.
- Pros and Owners choose at their own discretion to work with each other. Stuardly is not liable for any of the outcomes that may arise from jobs being worked on.

(a) Stuardly Inc. provides the Stuardly Platform on an "as is" basis without any warranties or conditions, whether express or implied. This includes, but is not limited to, the absence of warranties for merchantability, fitness for a particular purpose, good and workmanlike services, and non-infringement. Stuardly Inc. disclaims any responsibility for errors, inaccuracies, personal injury, property damage, or events beyond its reasonable control. The platform does not guarantee the accuracy or completeness of content and assumes no liability for any transactions between users or with third-party providers. Stuardly Inc. advises users to use caution and exercise judgment, explicitly stating that it does not warrant uninterrupted access or error-free operation of the Stuardly Platform.
(b) Users acknowledge that Stuardly Inc. offers the Stuardly Platform with limitations on liability. Users agree not to hold Stuardly Inc. and Affiliates liable for any claims, demands, damages, expenses, losses, or disputes arising from platform use. Stuardly Inc. expressly disclaims any liability between users and does not guarantee the quality or fitness of services.
8. Cancellation Policy:
- Pros can cancel a job at any time, and funds will be automatically returned to the Owner's account.
- Owners are responsible for canceling jobs with more than 24 hours' notice to be eligible for a refund.
9. Termination:
- Stuardly reserves the right to terminate the account of any user who violates these terms and conditions.
10. Dispute Resolution:
- Disputes between Owners and Pros will be resolved through Stuardly's dispute resolution process.
- Both Owners and Pros can submit claims to be reviewed by Stuardly to determine an outcome
- Owners and Pros agree to the Community Pledge and will abide by all of the directions and rules for communication and resolution.
11. Platform Updates:
- Stuardly reserves the right to update these terms and conditions. Users will be notified of any changes.
12. Governing Law:
- These terms are governed by the laws of [Your Jurisdiction].
13. Force Majeure:
- Stuardly is not liable for any failure or delay in performance due to circumstances beyond its control.
14. Severability:
- If any provision of these terms is found to be unenforceable, the remaining provisions will still be valid.
15. Contact Information:
- Users must provide accurate contact information for communication related to the platform.
